This Addendum applies to individuals, including those who are located within the jurisdiction of the Republic of Indonesia, as well as any persons whose activities outside Indonesia produce legal consequences within Indonesia (collectively, “Indonesian Residents and Citizens”).
This Addendum supplements the Terms of Use and shall prevail over any conflicting or inconsistent provision therein, to the extent required to comply with mandatory provisions of applicable Indonesian laws and regulations, as amended from time to time. Unless otherwise defined or the context otherwise requires, capitalized terms used in this Addendum shall have the meanings as set forth in the Terms of Use.
Article 1. Applicability of Indonesian laws
If and to the extent any provision of the Terms of Use conflicts with mandatory provisions of Indonesian law, such provision shall not apply, and the relevant provisions of this Addendum shall prevail. Nothing in the Terms of Use or this Addendum is intended to exclude, limit, or reduce any non-waivable rights of consumers or other mandatory protections provided under Indonesian law.
Article 2. Changes, Suspension, and Termination
Any changes, modifications, additions or removals of parts of the Terms of Use made pursuant to Article 1(3):
a. will not affect rights and obligations arising from transactions that have already been completed (including orders already placed and paid for) prior to the effective date of such changes; and
b. shall bind Indonesian Residents and Citizens only on a going-forward basis after the changes have been properly notified and made available in Indonesian language, and after they continue to use the Services or place new orders.
Indonesian Residents and Citizens who do not agree with the revised Terms of Use may stop using the Services and/or cease placing new orders. This does not affect their rights with respect to transactions concluded before the effective date of the change. For the avoidance of doubt, nothing in Article 1(3) shall be interpreted as obliging Indonesian Residents and Citizens to comply with new regulations or further amendments that are unilaterally determined in a way that is prohibited under mandatory Indonesian consumer protection law.
Article 3. Limitation of Liability and Disclaimer
Articles 8 (Limitation of Liability) and 9 (Disclaimer of Warranty) shall apply only to the extent permitted under mandatory Indonesian law. Nothing in those Articles shall be construed to exclude or limit Sanrio’s liability where such liability cannot be excluded or limited under Indonesian law, including statutory obligations to provide compensation, refunds, replacement, or other remedies for losses arising from defective goods or services, misleading information, or violations of applicable laws. Any exclusion or limitation that conflicts with mandatory Indonesian law shall be deemed inapplicable to Indonesian Residents and Citizens, without affecting the remaining provisions of the Terms of Use.
Article 4. Language
This Terms of Use, including this Addendum, will be made available in both Indonesian and English. In the event of any inconsistency, the Indonesian version shall prevail to the extent necessary to ensure valid consent under applicable law.
